All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
USER CONTRIBUTIONS
The Site may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, Company e-mail addresses, Company phone numbers, Company contact information, and other features (collectively, “Interactive Services”) that allow users to transmit, post, submit, publish, or display to the Company or to other users or other persons (hereinafter, “transmit”) content or materials (collectively, “User Contributions”) on or via the Site or to the Company.

By submitting any User Contribution to Lorals, you are agreeing and you do agree that Lorals has the right to publish any such material for any type of use as outlined above including for promotional and advertising purposes, without compensation of any kind to you, and you waive any and all rights of publicity, privacy, or any other rights of a similar nature, in addition to any moral rights you may have in the material. As a result, we must ask that you do not send us any original creative materials such as stories, product ideas, catalog ideas, or original artwork. However, if you choose to do so, you are forever assigning all rights in such original creative materials to Lorals.
You represent and warrant that:
- You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our licensees, successors, and assigns.
- All of your User Contributions do and will comply with these Terms of Use.
You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not the Company, have fully responsibility for such content, including its legality, reliability, accuracy and appropriateness.
We are not responsible, or liable to any third party, for the content or accuracy of any User Contributions posted by you or any other user of the Site.
MONITORING AND ENFORCEMENT; TERMINATION
Lorals has no obligation to display or post any User Contributions. We have the right to:
- Remove, delete, redact, modify, or refuse to post any User Contributions for any or no reason in our sole discretion, at any time and from time to time, without notice or further obligation to you.
- Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms of Use, including the Content Standards, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Site or the public, or could create liability for the Company.
- Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.

- Impersonate any person, or misrepresent your identity or affiliation with any person or organization.
- Involve commercial activities or sales, such as contests, sweepstakes, and other sales promotions; barter; or advertising.
- Give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.
DIGITAL MILLENNIUM COPYRIGHT ACT
The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. We will provide notice to you promptly of any such claim, suit, or proceeding. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” If you are a resident of another jurisdiction, you waive any comparable statute or doctrine.
DISPUTE RESOLUTION
Please read this section carefully as it affects your rights. These Terms of Use and the relationship between you and Lorals will be governed by the laws of the State of California without regard to its conflict of laws provisions. You and Lorals agree to submit to the personal and exclusive arbitration of any disputes relating to your use of the Site under the rules of the American Arbitration Association. Any such arbitration, to the extent necessary, will be conducted in Los Angeles County in the State of California. You covenant not to sue Lorals in any other forum.
You also acknowledge and understand that, with respect to any dispute with the Released Parties arising out of or relating to your use of the Site, purchase of a Product, or these Terms of Use:
- You are giving up your right to have a trial by jury
- You are giving up your right to serve as a representative, as a private attorney general, or in any other representative capacity, or to participate as a member of a class of claimants, in any lawsuit involving any such dispute; and
- You must file any claim within one (1) year after such claim arose or it is forever barred.
You and Lorals agree that each of us may bring claims against the other only on an individual basis and not as part of any purported class or representative action or proceeding. Unless both you and Lorals agree otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims, and may not otherwise preside over any form of a consolidated, representative, or class proceeding. Also, the arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s). Any relief awarded cannot affect other Lorals users.
TERMINATION
Notwithstanding any of these Terms of Use, we reserve the right, without notice or attendant liability, and in our sole discretion, to terminate your license to use this Site, and to block or prevent future access to and use of this Site for any reason or no reason. Upon termination, these Terms of Use will still apply.

WAIVER
Either party’s failure to partially or fully exercise any rights or waiver of any breach of these Terms of Use by the other party shall not prevent such party’s subsequent exercise of such right or be deemed a waiver by such party of any subsequent breach by the other party of the same or any other term of these Terms of Use.
SEVERABILITY
If any of these Terms of Use is deemed invalid, void, or for any reason unenforceable, that term will be severed and will not affect the validity and enforceability of any remaining term or condition.
ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between the user and Lorals with respect to this Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to this Site. A printed version of these Terms of Use and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.
